Pinnacle Equestrian Tour — General Release & Waiver of Liability

I understand that horseback riding, equestrian competition, and related activities are inherently dangerous and involve risk of serious injury or death to riders, horses, and spectators. I voluntarily choose to participate (or allow my child/horse) in events hosted by the Pinnacle Equestrian Tour and accept full responsibility for all risks, whether known or unknown.

These risks include, but are not limited to: falls, collisions, kicks, bites, unpredictable or uncontrollable horse behavior (even in well-trained horses), equipment failure or malfunction, arena footing and ground conditions, adverse weather, and the actions of other participants, animals, or third parties. I expressly acknowledge that no level of experience, training, or precaution can eliminate these inherent risks, and I voluntarily assume all such risks in full.

In consideration for being permitted to participate in any Pinnacle Equestrian Tour event, I, on behalf of myself, my heirs, representatives, successors, and assigns, hereby release and hold harmless Pinnacle Equestrian Tour, LLC, its owners, affiliates, sponsors, officials, employees, volunteers, event organizers, landowners, and facility operators (collectively "Released Parties") from any and all claims, demands, causes of action, damages, or liability of any kind arising out of or connected with participation in any PET event, including those caused by the ordinary negligence of the Released Parties.

This release does not apply to claims arising directly from the gross negligence, willful misconduct, or intentional acts of the Released Parties. Nothing in this waiver is intended to, or shall be construed to, release liability beyond what is permitted under applicable Arizona law.

I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, costs, attorney's fees, or liabilities arising out of my participation (or my child's participation) in any PET event or from my presence at the show grounds, including injury or damage to other persons, animals, or property.

In the event of an accident or medical emergency, I authorize PET officials, staff, or medical personnel on site to secure emergency medical treatment as deemed necessary for myself, my child, or my horse. I assume full financial responsibility for any such treatment.

I acknowledge that I have been informed of and understand applicable state Equine Activity Liability laws, which limit the liability of equine professionals and event organizers. I understand that I am participating in equine activities at my own risk.

I grant Pinnacle Equestrian Tour, LLC and its affiliates permission to use photographs, video, or other media of me, my child, or my horse taken during events for promotional, educational, or marketing purposes in print, digital, and online formats, without compensation.

I agree to abide by all Pinnacle Equestrian Tour rules, event regulations, and facility policies. I understand that violation of any rule or unsafe conduct may result in disqualification or removal from the grounds without refund.

Where a participant is under the age of 18, the parent or legal guardian executing this waiver on the minor's behalf expressly agrees to all terms and conditions herein, voluntarily assumes all risks on the minor's behalf, and releases the Released Parties from all claims of any nature arising from the minor's participation in any PET event.

The parent or guardian further agrees to indemnify and hold harmless the Released Parties from any and all claims, actions, damages, or costs brought by, through, or on behalf of the minor. I acknowledge that the enforceability of parental waivers executed on behalf of minors may be subject to limitations under Arizona law and agree to be bound to the fullest extent permitted by applicable law.

I acknowledge and understand that Pinnacle Equestrian Tour, LLC does not provide health insurance, personal liability coverage, or equine mortality or liability insurance on behalf of participants, their horses, or their property. Each participant is solely responsible for maintaining adequate and appropriate insurance coverage prior to attending any PET event.

PET strongly encourages all participants, owners, and trainers to secure appropriate health, liability, and equine insurance coverage. Failure to maintain such coverage is solely the participant's risk and responsibility, and PET shall bear no liability for any uninsured losses.

Any dispute, claim, or controversy arising out of or related to this Waiver, or to participation in any PET event, shall first be submitted to non-binding mediation in Maricopa County, Arizona, as a condition precedent to further legal proceedings. If mediation does not resolve the matter within sixty (60) days of initiation, the dispute shall be resolved through binding arbitration conducted in Maricopa County, Arizona, under the then-current rules of the American Arbitration Association.

The prevailing party in any such arbitration or related court proceeding shall be entitled to recover its reasonable attorney's fees and costs. By agreeing to this Waiver, I expressly waive any right to a jury trial and waive any right to participate as a plaintiff or class member in any class action, class arbitration, or other representative proceeding related to PET events or this agreement.

By registering for, entering, participating in, or being present at any Pinnacle Equestrian Tour event, I acknowledge that I have read, understood, and voluntarily agree to all terms and conditions set forth in this Waiver and Release of Liability. This agreement applies to all circuits — including the Training Circuit (Pinnacle Cup), Unrated Circuit, Rated Circuit, and Young Horse Circuit (Next Gen Cup) — and to all persons involved, including riders, owners, trainers, coaches, parents, and spectators.

This Release shall be governed by the laws of the State of Arizona and is binding upon me, my heirs, legal representatives, and assigns. If any portion is found invalid, the remaining provisions shall continue in full force and effect.
